Wiper Movement and Chama Cha Mashinani parties have inked a post-election coalition agreement with the ruling Jubilee party.

Party leaders Kalonzo Musyoka and Isaac Rutto signed the agreement at the Jubilee party Headquarters in Nairobi on Wednesday afternoon.

They were received by Jubilee party Secretary General Raphael Tuju.

Last month, the Wiper boss revealed that the party’s National Executive Council had given the leadership a green light to seal a co-operation agreement with Jubilee.

Today’s agreement comes weeks after independence party KANU signed a similar pact with Jubilee.

The KANU-Jubilee merger saw West Pokot Senator Samuel Poghisio named the Senate Majority Leader.

Kalonzo and Rutto are now poised to enjoy similar offers.

KRA Nil Returns applies to those who do not have a source of income sometimes referred to as the unemployed. Source of income in the sense that the taxpayer does not have income from Rental, Business, or Employment. Kindly note that every Kenyan, who has a valid KRA PIN is required to declare their annual income every year before 30th June of the following year.

If not employed and do not have an alternative source of income i.e Rental, Business, or Consultancy income you file nil returns. If you have a KRA PIN, the law states that you should file a return. If you have no income file a nil return. Failure to do so as indicated in the Tax Procedures Act leads to penalties.

Please be informed that the penalty is now Kshs. 2,000 for the late filing of individual returns. This is stipulated in the 2018 Finance Act. If you are in employment, you need to file KRA Returns using your P9 Form. You can read the step by step guide below:-

How To File KRA Nil Returns

It is important that if you have an active KRA PIN on iTax, you should ensure that you file your KRA Returns each and every year between 1st January to 30th June. These dates are very important to note down is you want to part of the tax compliant Kenyans.

The Tax Procedures Act states that if a return is not submitted by the respective due date a penalty will be imposed.

Requirements Needed For Filing KRA Nil Returns

To be able to file your KRA Nil Returns on iTax, you need to ensure that you have with you KRA PIN Number and KRA iTax Password. Before we get started on the various steps, you need to ensure that you have the following two items with you:

  • Your KRA PIN Number
  • Your KRA iTax Password

For you to able to file your KRA Nil Returns on KRA iTax Web Portal, you need to ensure that you have with you two key requirements i.e KRA PIN Number and KRA iTax Password. We are going to look at each of these KRA Nil Returns requirements in brief details below.

KRA PIN Number

This the most fundamental requirement for the process of filing KRA returns to kick off. This pin can be obtained from your KRA certificate. It’s an alphanumerical (consisting of both letters and numbers) pin.

iTax Password

This will enable you to log in to your iTax portal. It is worth noting that in case you do not remember your iTax password, you can reset it by clicking on Forgot Password/Unlock Account, solve the security stamp question and then click on submit.

Your new password will be sent to the email that you used during registration of KRA.

Step-by-Step How to File KRA Nil Returns

Step 1:  Login to your iTax portal by clicking this link https://itax.kra.go.ke/KRA-Portal/. Enter you KRA alphanumeric Pin then click continue.

Enter your Password, solve the Security Stamp sum and then click on login. You are now logged in your KRA iTax portal dashboard.

Step 2: While in your iTax portal hover the cursor around the Returns and then click on File Nil return on drop down menu as shown below.

Step 3: Select Tax Obligation as Income Tax – Resident Individual as shown below then tap on Next.

Step 4: Here you select the return period. The return period (01/01/2024 to 31/12/2024) automatically autofills by itself as shown below.

Click on the submit button to proceed.

Step 5: On clicking submit button, the next thing is to download KRA Nil Returns Receipt.

The KRA P9 Form is the form from KRA Income Tax Department that is given to employees by their employer. It shows the employee what they had earned in the previous year and how tax has been deducted from those earnings.

This is the form that contains the information that you will be used to fill the KRA iTax Returns form online in the KRA Portal.

How to File KRA Returns using P9 Form

All Individuals with employment income must pay income tax and therefore need to be supplied with a KRA P9 Form by their employer.

So, depending on your company structure, visit your Human Resource Officer (HR) for your KRA P9 Form copy.

How does a KRA P9 Form Look Like?

Counties are geographical units within the country. They came into existence due to the new 2010 constitution of Kenya. You can check out this list of all county governors in Kenya that got elected in August 2024.

It contributed to the formation of each county government in the forty-seven regions.

The governor is the chief executive of the county.

All members of the county executive committee are answerable to the governor.

The duties of the governor include:

  1. To preside over the official opening of the county government
  2. To oversee the implementation of county legislation
  3. To supervise the management of county departments
  4. To chair county executive committee meetings

The county governments have the responsibility to provide services to the community within their jurisdiction. The functions of the county government include the following:

  1. Collecting revenue
  2. Providing health services
  3. Building and maintaining roads
  4. Proving nursery and primary schools.
  5. Collecting garbage
  6. Providing sewerage and drainage services
  7. Providing clean water
  8. Allocating land for special uses
  9. Protecting public land
  10. Passing by-laws

Apart from all the duties the county governors perform, they are one of the highest-paid public servants.

The Salaries And Remuneration Commission (SRC) has set the governor’s salary and allowances at Ksh 924,000 per month which includes a basic salary of Ksh 554,000, and a house allowance of Ksh 200,000, and Ksh 170,000 for market adjustments.

Most people usually misplace their KRA Pin certificates or forget the email address they registered KRA Pin with where the KRA Pin details were sent.

Now you will not trouble your mind with questions like, How do I Get My KRA Pin after Losing It? or I lost my KRA pin what do I do? The good news is that Kenya Revenue Authority has put in place several ways to help you recover your forgotten Pin Number or email address

You can do either of the following to recover your lost or forgotten KRA Pin Number or email address

Method 1: Visit the closest KRA Office with your Original ID Card to request for your pin or email address

Method 2. Scan in colour (not black and white), both sides of your National ID and send it to KRA via KRA email address callcentre@kra.go.ke. Put the subject of your email as KRA pin. However this is slower compared to the use of their Facebook and Twitter social media handles.

Method 3: Send a direct message (DM) and a coloured copy of your National ID to any of the KRA social media handles Facebook or Twitter, requesting for your pin. The response here from KRA is faster than via email.Loading…

Method 4: Visit Huduma centers across the country with a copy of your original National ID Card.

Method 5: Call 0711099999, 020-3310900 and 020-281000, fax 341342

How to Reset Forgot KRA Password

If you have forgotten your KRA Portal password, you can reset it by clicking on the ‘Forgot Password/Unlock Account’ link below the tabs. For you to find that link you have to type your correct pin number and click ‘continue

Another page will appear. Just click on the forgot password/unlock account link. This will land you to a new forgot password portal.

Here you will find a security stamp question. Fill all the required fields and submit the data.

An email from KRA will be sent to you through your registered email address. It will contain your log in details including a new password. Use this new password to login to your account.

After you log in, make sure you change your password and enter your new security question plus the answer. This new password should be unique, personal and secret and easy to remember. It should have not less than eight characters that are alpha-numeric ie (should contain letters with both upper and lower cases, numbers and special characters)

Forgot KRA Email or want to change your KRA Email Address in your KRA Portal

Have you forgotten your email address? or has your email been compromised or your email is no longer accessible? (e.g you had registered KRA using your former employer’s company email). Worry no more! You can now change your email address on KRA portal.

How to change your KRA Email Address in your KRA Portal

1. To change your KRA email address, log in to your KRA Portal click on the Registration Tab.

2. Click on the Amend PIN Details and a new window opens.

3. The e-amendment of registration form will open. Click to open the online form. Check the box beside the PIN field to view all the editable sections. All the amendable fields will be shown, Tick the Checkbox with the basic information part

5. Click on the Principal Contact details and type your new KRA email address.

6. Click on the submit icon. You will receive a notification you that you have entered a new KRA email as the main email address on iTax Portal.

7. Click the OK button.

8. You will get a notification confirming the finalization of the KRA email address change in the KRA Portal.

9. After the KRA Personnel verifies and approves the KRA email change, an email will be sent to you with a downloadable PIN certificate with the updated email address.

The government has declared Busia, Vihiga, Kisii, Nyamira, Kakamega, Kericho, Bomet, Bungoma, Trans-Nzoia, Kisumu, Siaya, Homa-Bay, and Migori Covid-19 hotspot zones.

Curfew to be observed between 07:00 p.m. and 4:00 a.m. in these zones effective tomorrow. Movement in and out of the select counties has been strongly discouraged.

The government has also banned all public gatherings and in-person meetings within the Hotspot Zone, including house parties and sporting activities.

The government has also suspended weekly non-food and livestock markets in the Hotspot Zone for 30 days.

The hours of the ongoing nationwide curfew shall continue to be observed in the rest of the country, from 10:00 p.m. and 4:00 a.m. daily.

The Kenya Revenue Authority (KRA) is the body mandated with collecting, assessing, and accounting for the revenue in Kenya on behalf of the state.

Kenyans generally pay two types of taxes: Direct and indirect taxes.

Direct taxes are the amounts you remit directly to the government as income tax.

Indirect taxes are those charges that you pay when you buy goods and services and they include Value Added Tax (VAT), excise duty, and custom taxes

1. Income Tax

Income tax is a tax charged for each year of income, upon all the income of a person whether resident or non-resident, which is accrued in or was derived from Kenya.

Income Tax is imposed on;

  • Business income from any trade or profession
  • Employment income
  • Rent income
  • Dividend and Interests
  • Pension income
  • Income from a Digital Marketplace
  • Natural resource income among others

There are different methods of collecting income tax from companies & partnerships, based on their sources of income.

These methods include:

a. Corporation Tax

This is a form of Income Tax that is levied on corporate bodies such as Limited companies, Trusts, and Co-operatives, on their annual income.

Companies that are based outside Kenya but operate in Kenya or have a branch in Kenya pay Corporation Tax on income accrued within Kenya only.

Do partnerships pay corporation tax?

b. Pay As You Earn (PAYE)

This is a method of collecting tax at source from individuals in gainful employment.

Companies and Partnerships with employees are required to deduct tax according to the prevailing tax rates from their employees’ salaries or wages on each payday for a month and remit the same to KRA on or before the 9th of the following month.

c. Withholding Tax (WHT)

This is a tax that is deductible from certain classes of income at the point of making a payment, to non-employees.

WHT is deducted at source from the following sources of income:

  • Interest
  • Dividends
  • Royalties
  • Management or professional fees (including consultancy, agency or contractual fees)
  • Commissions
  • Pensions
  • Rent received by non-residents
  • Other payments specified

Companies and partnerships making the payment, are responsible for deducting and remitting the tax to the Commissioner of Domestic Taxes.

d. Advance Tax

This is a tax paid in advance before a public service vehicle or a commercial vehicle goes for the annual inspection.

e. Installment Tax

Installment tax is paid by persons who have tax payable for any year that amounts to Kshs. 40,000 and above.

2. Rental Income Tax

This is a tax charged on rental income received from renting out property. Taxation of rental income depends on how the rented property was used for residential or commercial purposes.

Companies and Partnerships that rent out property to other persons for either residential or commercial use are required to pay income tax on rent received

3. Value Added Tax (VAT)

Value Added Tax is charged on supply of taxable goods or services made or provided in Kenya and on importation of taxable goods or services into Kenya.

While companies & partnerships can voluntarily register for VAT they MUST register if their annual revenue exceeds Kshs. 5,000, 000.

To facilitate compliance, KRA appoints agents to withhold and pay, VAT on supplies made. These agents can be verified via the agent checker on iTax.

4. Excise Duty

This is a duty of excise imposed on;

  • goods manufactured in Kenya, or;
  • imported into Kenya and specified in the 1st schedule to Excise Duty Act, 2015.

Companies and Partnerships dealing in excisable good and services are required to pay excise duty.

The List and types of Excisable goods and services are listed in the 5th Schedule as read together with Section 117 (1) (d) of the Customs and Excise Act, CAP 472 Laws of Kenya.

They includes;

  • Mineral water
  • Juices, soft drinks
  • Cosmetics and Preparations for use on hair
  • Other beer made from malt
  • Opaque beer
  • Mobile cellular phone services
  • Fees charged for money transfer among others

5. Capital Gains Tax (CGT)

This is a tax chargeable on the whole of a gain which accrues to a company or an individual upon transfer of property situated in Kenya, whether or not the property was acquired before 1st January, 2015.

It took effect on 1st January 2015.

6. Agency Revenue

This is a type of payment that KRA collects on behalf of various revenue collection agencies in Kenya.

The two types of Agency Revenue include;

  • Stamp Duty
  • Betting and Pool Tax

a. Stamp Duty

Stamp duty is a tax charged on transfer of properties, shares and stock.

It is collected by the Ministry of Lands, which has seconded the function to Kenya Revenue Authority (KRA).

b. Betting Tax

Betting Tax is chargeable on the gross gaming revenue (GGR) of a bookmaker at the rate of 15% as provided by Section 29A of the Betting, Lotteries and Gaming Act, 1966.

Betting, gaming and Lottery businesses are required to withold as tax and remit to KRA 20% of the winnings being paid out to winners.

Excise Duty on Betting is chargeable at the rate of 20% of the amount wagered or staked, commencing 7th November, 2024.
